USICS or Lawyer which is worse?

Well I failed to announce my dear did get her packet 3, USICS failed to fix her name like they said they would do by Nov 29th. Dec 6 National Visa Center got her papers and oh yea, I must show proof of support for her at the Embassy interview. So I requested my kind, smart, and gracious Lawyer to send me copies so I can send to my fiancee and she can take with her for her interview. I still do not understand why it says on a printout pdf from NVC if you submitted your Affidavits of support during your petitions phase you do not need to show it for the interview. I can never get a strait answer from any one. USICS says we have to show them and then we must show the Embassy. So in this day and age of Identity theft your Bank account number, SS number and Address is floating around the halls of Home land security. Every one assures me they are safe but I still remember the Home land security person being arrested for Theft at Wal-mart. He was stealing Big screen Tv's.

Any way. While reviewing my papers my LAWYER sent me I notice she put a wrong address for my mother, she also misspelled my fiancee's name 2 places on the petition I had told her and you this before.
When I mention this to her I get the same old song and dance that this phase is over why am I brining it up... Never do I get an apology only made to feel it is some how my fault. So I pointed out to her she does not apologize and always blames me. She fired me... Funny hu.
Sadly there is more bad news. My fiancee had a physical back in September, she had an Xray and showed no signs of TB. She went for her medical for the embassy and she has an Xray saying she has TB. She is doing treatment and I hope it will go away. It was caught early so I am hopeful. I asked my LAWYER and all I get is the same old answer of Each Embassy is diffrent and they will decide. I find this hard to belive becsue this is Government, they have rules for every thing. Even Judges must fallow Rules. I will post the out come. Maybe this informations will help some one some day.

Waiting on NVC packet 3

K1 update. I have been, trying to fix a mess up by the Lawyer, she does not seem to care or want to fix her mess-up. My Fiancé’s last name was misspelled in 2 places on the petition and now USCIS is miss spelling her last name. I told the Lawyer the day she mailed the papers but she said it was not a problem. I asked USCIS and they told me to fax my problem. I started this like on the 8th of October, faxed them the papers they requested on the 12th of October, the said to call on the 30th of October. Her name is still not fixed. The Lawyer said they will fix it at the Embassy but USCIS says this can be sent back to stage one, or cause problems later on with other papers we must file.
I have called several times but all I am told now is they have 30 days to fix the name.
I got our NVC National Visa Center number and called DC about it. They told me around the 7th of Nov. Nings packet 3 was mailed to her. It is now the 14th I am sure she has not gotten it she would be telling me. I believe the medical stuff she must do for the Embassy will cost around 200 dollars. I plan to call and find out where the packet 3 disappeared too and find out any thing new. I guess I will ask what NVC will do about her Name being misspelled.
I was told the first time I called USCIS that when her papers got to the Embassy in Bangkok the process will take 3 months. I hope she is here by Jan, but I suspect Feb. I hope she will spend my Birthday with me here. January will be a year since we had seen each other. I left Thailand January 15 2007. I guess at least we got to spend the new year together. I’m trying to stay positive.

i-797 notice

I called and emailed the Lawyer October 3rd after seeing the case status change, she emailed me back 5 days later to tell me how every thing is going to plan and she did not know why they did not send her a receipt number. She told me with my case being approved on the Oct. 2nd, she should get her letter in two weeks. Today the 9th of Oct. I got my notice. I also called immigration to ask if it is true if my Fiancee will need all our correspondence from over the years that we submitted for the petition. They tell me yes she will need for her interview... Wonder why my Lawyer has not told me this.
So I asked, because she told me" Please if you have anything further, do not hesitate to contact us. Email is always best as I can answer day or night.. "
I am so frustrated. To any one doing this, Don't pay your Lawyer in full and make sure you like them and can ask questions. I will post again soon I hope.

Got some good news today.

Today I logged in this morning and check the status of my case for Ning and it said the same thing it has said for the past 5 and a half months. Your petition was received but is pending further review.
I checked later today at 3 pm because Ning has been on me to call if no change, and oh yea it is so pretty I will show you what it says below.

There is a reason they have so many lawyer jokes.

Lawyers, I had heard all the jokes, the horror stories but never had a problem with one. If I did not like the feeling I got from the first meeting then I would not use the lawyer.
With this one, well. As I was saying before I asked my mom to find one, because I knew I would not be able to stay in Thailand and I wanted to ask one what they would need from Ning so I could bring back with me rather then playing phone and email message trying to gather every thing. My mom found one and gave me her number and email.
I emailed the lawyer and she kept telling me she was going to call soon but never did. So one day I decided to call her. I think after she told me about 3 times she would call and that was in a week’s time.
When I did call, she seemed Argent but I can over look that so long as it is not directed at me.
Before I had spoke to her my mom told me the whole thing would be easy all I had to do is tell Ning to apply for a vacation visa and come over and we would marry and she would do the papers.
When my mom told me she this I said no no no. Ning is poor; she can not come over on a tour visa.
I don’t know about you but I don’t see many, poor, single, women from developing nations in the USA on vacation.
From what I’ve been told by friends I have who have been aloud there parents was rich, or they were older and married. I know from reading some sites that the government has flags that go up when you don’t meet certain requirements and they will not let you come to the States. I was shocked that an Immigration lawyer did not know this. So when we had our first conversation her first comment to me was. “So your mom tells me she can not travel to the states…?” I explained why I did not think Ning could do that. She gave no argument that I was wrong.
She then asked me what I wanted to do. I said I wanted to do the K1 fiancée, she then said ok and said she wanted to file while I was still in Thailand. I had read the K1 requirements’ on Immigrations web site so I knew vaguely what they wanted from me but not from Ning, so I tried to tell her how I did not feel we could file from Thailand. When I began to give reasons like I had to sign papers she wanted in person and before I could finish my sentence she told me nonsense we have FedEX. I tried to tell her other concerns about I did not have key documents, like Birth certificate and a few other things she made excuses she could use this or that for those problems. I reluctantly agreed with her that we could file from Thailand but did not like the idea. I am still not sure if it is legal. So after I agreed she told me she would email me in a few days with a list of things I should get. I will copy the email but, I do not want to disclose her name or any thing else because she would most likely take me to court.

My K1 visa Experiance for all who dare to do one.

I am writing this blog to share my headaches, fears and frustrations with lawyers, the government and differences of culture. I am in the process of doing a k1 Fiancée visa for my fiancée who is now in Thailand. Ning and I met through a mutual friend and had been communicating online for almost two years before we met in person at Suvarnabhumi Bangkok Airport.

My mother and I arrived at night surprisingly on the 20th of September 2006. If you do not know this date, lets just say the night before we watched CNN and other News stations try to tell us how the end of Thailand was coming because of Military coupe.

If you do know a little about it then you know the coupe was bloodless and we where not in any danger. My mother stayed in Bangkok for a week while she got to know Ning and Ning gave us a tour of Bangkok on her days off.
After that week of being pampered at the Windsor suites hotel in BKK. My mother returned to the States. I moved from Bangkok to a condo south of Bangkok near where Nings condo was. This was in a City called Chonburi. Now I being from USA, I would look at this name and say Chonbur I but in Thailand they use lower case I to mean E.
Ning lived close enough for us to eat dinner at night and go see movies. My condo was great but I had to get used to cold showers. It was hard to deal with the first week but I think after I became fine. My intentions were to stay in Thailand and help people with English and get to know Ning, I had enough in savings to stay and before the coupe Thailand had a lax visa policy. I had gotten two visa’s to stay for a while both was 60 days but one expired early so. Ning and I went to visit Laos, and came back for passport stamp which aloud me to stay a little longer. Through Nings co workers I met other friends a Colonel in the Thai army, his wife a teacher and they had a son. The teacher ran a school from home an after school tutoring so they offered me to come and help the kids. I did not get paid much but I did it to make friends and put my TEFL training to use.
Ning and I had the weekends and dinner at night and I went to teach most days, and other days I would go places with friends.
My Thai got ok but the highest number of words I learned fluent was around 300 to 500 just enough to catch about every 3rd word when some one would speak Thai as they would to a normal Thai person. My greetings got so good and I could count to ten thousand people thought I could speak Thai. I was able to stay in Thailand for about 5 months and many problems came up with the new visa rules, family problems at home so I came back to the states, missing Ning 15 pounds lighter. While I was still in Thailand I had my mother find an immigration lawyer, and this was a mistake. I will explain more on her later.
