We finally got the green card, the interview was uneventful. They called Ning back with Krista our Lawyer and then called me back to ask one question. My question was how did I meet my wife. I answered and that was it. I'm open to any one needing questions answered and if you need a good Immigration lawyer in Tampa, Fl call Neil Lewis or Krista Eyler his partner.

Interview on the 25th of Sept
After the email I got from the Embassy saying they was not going to accept my cosponsor, I decided to fly to Thailand and try to make my case. I flew in at 11:55pm on the 24th of Sept Bangkok time, I got to the hotel after 12am, sleeping a few hours we got up at 6am and left for the Embassy at 7am. For those of us who have been in Bangkok traffic you know it took an hour to get to the Embassy and cross the road like Fogger. When we got to the gate, I was told I could not go in for the interview. I was left standing out side on the street for hours. I later was told this had changed a week before because some one showed there but when a visa was denied. I stood out side talking to other Americans, one married who explain to me how to get married the easy way, and another working as a contractor for the government. I watched many people come out with long faces, including Mathews wife who applied for a 10 month visa to the States. After they left Ning come out side to get me, telling me the Embassy had questions about my eyesight and employment. I told the officer about my eyesight, I explained why I had not worked, and he was nice about it. He said because of the evidence and supporting documents, he was going to approve the visa!!!!!!!!!!!!! I honestly almost fell on the ground at that point. I thanked him and we talked about the fact that my mom had signed the i864 form when we filed the petition he was going to let it happen because he felt with me owning 2 houses with my mother, the letter from my mother, and as he said the mountain of evidence he decided Ning would not be a public charge and if she was the government could use the i864 against my mother. I told him I was not sure if the i864 could be used for the k1visa or not, but he said it is not supposed to be but it did count none the less. He told us to come back 3pm on Monday for her visa to be put in her passport and we did. Now we are planning her coming to live with me in Jan of 2009, because Ning wants to work until December 26th to get her bonus and give to her mom and dad. Right now we are just spending time together and buying gifts for friends.
I still feel the same that this is a long drawn out process and the CR1 is less time. Had I known I would have done that.

Any one thinking of K1 visa DO NOT DO IT!!!
It is now coming on our year and a half point of this K1 visa. Things I've found out it is slow, people are rude, you can get bad lawyers, and you will miss your love one a lot. I recommend marrying who ever you want to do the k1 for in the country they are from. Then come home and do a CR1 visa.
After the Embassy cancled out first interview, and pushed our interview back 9 months for TB treatment, they now have changed rules of no co sponsors for i134 stage. I would be fine but I Stayed home the past year to help care for my niece Brook who has had her 2nd Heart Transplant.
My mother who agreeed to do the cosponsor ship, is a nurse and has custody of my niece and asked me to stay home becasue she can earn more an hour and get medical insurance. I agreed but that puts me well below the amoutn of 125% of poverty wage that the Embassy will ask that you make.
I've done all they asked me to do, I've proven our realationship above and beyond the proff they ask. Now the over 4 thousand dollars spent on lawyers medicen, mailing things, fee's they ask for. Well it is going to be Denyed. As a last stance I have mailed and emailed my Senator, but when I called they claim to have not found my letter yet and for me to call back in a week, I called in a week now they say call in 2 weeks. I've done all I can and now I must wait for the Embassy in Bangkok to deny the visa, so I can fly back over Marry Ning and come back to file for a new CR1 visa and wait a year on that process to happen for her to go do another medical exam, and get another interview, so I can use a cosponsor. Yes you can use a co sponsor on CR1 but not K1. The diffrance i864 form. I would argue that the first lawyer made my mother and I fill out the i864 form and it does not aply to the k1 visa. The embassy I'm sure will say it does not aply to your case and you can not use it.
I think the Whole system sucks I find it un bealiveable that our government would make a department that has no oversight, no way to complain about unfair treatment, and your case can be decided by one person. I'm just angry and sick at the thought of the time lost because a lawyer does not know her job. I even asked her before I left Thailand if it is better to marry her there or come back and do the k1 and she said and I quote I Don't know, do not marry her, I don't know Thai laws or how long she will have to wait before she can come. We will find out what happens on Sept 25th what happens.
I love Ning and I'm not going to not Marry her and come back and do the visa but I think it is stupid they will make me spend the money to do it when it is the same thing minus 1 form.
My advise is don't do K1. Hope I help in some insight.

New Interview date finally
After a long wait and having to cancel the first interview because of the TB, Ning was called yesterday and the new interview date was set for mid September. They old Medical exam has expired so she will have to do a new one also a new police report. finally some thing new.

New Lawyer.
I finally had to do it, I got a new Lawyer. My fiance kept asking me for an original i134, the one my old lawyer had me send was a copy, and when I wrote an email for my fiance to ask her for a new one that would be original, the lawyer told my fiance for me to do it myself.
I went and got a new one, I had to pay a lot for 2 papers but the new lawyer was a much better experience. Krista the new Lawyer even researched about the TB. I've sent every thing but I was concerned about time and I had to push back her interview date. This works out ok because she has not finished her MMR Vaccines and that gives her more time on her TB treatment.
Any one wants a good immigration lawyer in Florida please contact me. I hope the new interview will be set in July or August.

I wish I had all good news to post but, I don't. The good news is my dear is going to her interview on her birthday. The bad news. The lawyer sent her unreadable i134, with false information and not all the supporting documents. I can not believe this woman. She has my mom living in Florida and working in Thailand doing Nings job earning 45 thousand a year...
So yes I will be filling a complaint with the Florida Bar. I am now looking for a new Lawyer and have a meeting on Tuesday. I hope I can get every thing done and set to Ning in time.
Let me just add if you don't like how your Lawyer talks to you or does any thing. Get a new one.

Packet 3 update
I did not understand when we got packet 3 we was to file the DC 230 when you get the packet and send your check list later when you have every thing, any one reading keep this in mind.
The Bkk embassy sent a letter requesting my Fiancee send her DC 230 in, so she did in time. She is doing Treatment for Tb now, Seems I was exposed while I lived in Thailand as well s0 I will do my treatment soon. We are now waiting for Packet 4 which we where told would come in 4 weeks. The Doctor told Ning that after treat ment the Embassy gives the visa. So I hope in 6 months she will be close to comeing here to live with me. Now we are well past a year of not seeing eachother. Funny how the Lawyer acted like it would only take 7 months. Now 13 months later. I miss my Teerak.
